Agreement Overview
This Client Agreement (“Agreement”) is entered into by and between Luana Feboli (Aluna Lua) and team members current and future, henceforth referred to as “Ascension Arts” (“Practitioner(s)”) and You (“Client”). This Agreement outlines the terms and conditions under which the Practitioner will provide a ceremony for the Client.
Please read these terms and conditions (“Terms”) carefully before completing your registration as they contain an agreement to arbitrate and other important information regarding your legal rights, remedies, and obligations. By accessing any areas of this site, you agree to be bound and to abide by the terms and conditions set forth below. If you do not agree with any part of the following terms and conditions, please do not process your payment.
These Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Ascension Arts (“Ascension Arts” or “Company” “Practitioners” or “us” or “we” or “our”), governing your access to and use of the www.alunalua.com website, Ascension Arts Community Group, as well as any other media form, media channel, mobile application or mobile website related or connected thereto (collectively, the “Site”), and any products (“Products”) or services supplied by or on behalf of us (collectively, “Services”). Supplemental terms and conditions or documents that may be posted on the Site from time to time, and any new features or tools that are added to the Site shall also be subject to and are hereby expressly incorporated into these Terms by reference.
1. Purpose of the event
1.1. Viva Santa Maria is a Cannabis Ceremony for psychedelic creatives to celebrate the Divine Feminine.
2. Client’s Health and Safety
2.1 Medical History: The Client agrees to disclose any and all medical conditions, including but not limited to heart disease, high blood pressure, mental health disorders, and any other relevant health information.
2.2 Medications and Supplements: The Client agrees to disclose all medications and supplements currently being taken.
2.3 Contraindications: The Client acknowledges that certain health conditions and medications may be contraindicated with the medicines provided. The Practitioner reserves the right to refuse service if it is deemed unsafe for the Client to participate.
3. Liability Waiver
3.1 General Release: I hereby release, indemnify, and hold harmless ASCENSION ARTS and their employees, agents, representatives, team members, as well as its owners, principals, employees, agents and representatives, with respect to any and all claims I now have or may have in the future resulting from injury, whether physical, mental, spiritual or emotional, or any loss or damage to person or property, of any kind arising from the negligence of ASCENSION ARTS to the fullest extent permitted by law.
3.2 Assumption of Risk: The Client acknowledges potential risks and assumes full responsibility for their choice, releasing Ascension Arts from all liabilities, including negligence.
3.3 No Medical or Therapy Services: The Client agrees that The Practitioner and Ascension Arts team members are not a medical care or therapy provider and do not diagnose, treat, or offer mental health services. The Client agrees to seek licensed professional support if they experience emotional distress or require therapy.
3.4 COVID-19 Responsibility: The Client assumes full responsibility for potential COVID-19 exposure.
3.5 Arbitration & Legal Agreement: The Client agrees that this Agreement fully releases ASCENSION ARTS from any and all liability related to their participation in the retreat. The Client further agrees that if they choose to file a claim, lawsuit, or any legal action against ASCENSION ARTS TEAM—despite this waiver—such action must be resolved exclusively through arbitration under the American Arbitration Association. The initiating party covers arbitration costs, and prevailing parties may recover legal fees. California law applies.
3.6 Health Conditions: The Client agrees to disclose their medical history honestly and consult a doctor if needed.
4. Participation and Expectations
4.1 Lodging at the Location: Limited on-site community lodging is available and confirmed upon registration. Clients who choose to stay on-site agree to respect the space limitations and to be kind, clean, and supportive toward all retreat guests. Clients opting for off-site accommodations are responsible for any additional costs and must ensure timely arrival for all activities.
4.2 Pre-Event Guidelines: The Client agrees to follow the Practitioner’s pre-retreat guidelines, including dietary restrictions, hydration protocols, and substance abstinence. If they make any modifications, they take full responsibility and agree to inform the Practitioner if guidelines were not followed.
4.3 Aftercare: The Client agrees to follow the Practitioner’s aftercare instructions to support integration and healing. They also take full responsibility for any personal adjustments to their diet or aftercare routine, trusting their intuition. The Client releases the Practitioner from any liability related to these modifications.
4.4 Zoom Calls: The Client agrees to engage in community calls and stay updated on content, announcements, and assignments. If they choose not to participate, they take full responsibility for any missed benefits and release the Practitioner from any liability regarding their results.
4.5: Accountability: The Client acknowledges that Ascension Arts is a community-based company that fosters accountability and safety among members. The Client consents to being contacted by other members throughout the duration of the membership for support and connection. If the Client wishes to limit communication with specific members, they agree to take personal responsibility in notifying those individuals directly. If further intervention is needed, the Client agrees to communicate their concerns to the Ascension Arts team via email.
4.6 Communication: All program-related communication must take place via group chat and email. The Practitioner is not obligated to respond to direct messages on text, Instagram, WhatsApp, or any other platform. Support with billing, student portal and personal concerns must be addressed respectfully via email. Email inquiries will generally receive a response within 3 business days.
5. Informed Consent
5.1 Understanding of Risks: The Client acknowledges that they have been informed about the nature of the medicine, including potential risks and benefits.
5.2 Voluntary Participation: The Client agrees that their participation in the event is voluntary and that they can choose to not partake in the medicines provided during the retreat or not join the event at any time. The Practitioner agrees to respect Client choices and The Client agrees to respect the experience of other members and that they are not entitled to request a refund for not participating in any of the activities provided, including their stay at the location.
5.3 Release of Liability: The Client agrees to release the Practitioner from any liability related to the event, including but not limited to physical, emotional, or psychological effects.
6. Confidentiality
6.1 The Practitioner agrees to maintain confidentiality regarding the Client’s personal information and health history, except as required by law or with the Client’s explicit consent.
6.2 The Client agrees to maintain confidentiality regarding Ascension Arts team members and any other community members personal information and health history, except as required by law or with each individual's explicit consent.
7. Payment and Cancellation Policy
7.1 Fees: The Client agrees to pay the full agreed-upon fee upon registration date.
7.2 No Refunds: Due to the amount of labor and time it takes to produce Ascension Arts products and services, The Client acknowledges that there are no refunds available for any payments made. By registering for this commitment, you agree to these terms.
7.6 Cancellation: The Client can cancel the event participation at any time through email. In cases where cancellations are made with more than than 3 days prior to the event, their spot may be deferred to a friend.
8. Media Release
8.1 Consent to Use Media: The Client agrees to grant the Practitioners permission to take photographs, video recordings, or audio recordings during the event. All zoom calls will be recorded and Ascension Arts holds the rights to publish the materials at their discretion.
8.2 Usage of Media: The Client consents to the use of these media materials for promotional, educational, and marketing purposes, including but not limited to social media, websites, and printed materials. If a video testimonial was captured during the event, The Practitioner agrees to request permission from the Client before publishing the edited material.
8.3 Revocation of Consent: The Client has the ability to remove themselves from a specific media opportunity during the retreat. However, any materials already captured, published or distributed cannot be withdrawn.
9. Intellectual Property
9.1 Ownership: All materials, content, and intellectual property provided by the Ascension Arts team during the event are and remain the exclusive property of the Practitioner.
9.2 Use of Materials: The Client agrees not to reproduce, distribute, or use any of the Ascension Arts materials, intellectual property or content without explicit written permission and credit Ascension Arts and their indigenous teachers properly with any use of permitted materials, teachings, techniques and songs.
9.3 Chat Moderation: We may, but have no obligation to, monitor, edit or remove User Content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or in violation of any party’s intellectual property or these Terms, or for any other reason.
10. Legal and Ethical Conduct of Integrity
10.1 Ethical Standards: Ascension Arts commits to conducting the event in alignment with ethical guidelines and harm reduction protocols. The Client agrees to follow all guidance before, during, and after the event.
10.2 Community Respect & Conduct: The Client agrees to uphold respect, kindness, and professionalism within all Ascension Arts spaces. Gossip, disruptive behavior, public defamation, or harm (physical, mental, spiritual, or emotional) will not be tolerated. Violations may result in termination of membership, retreat access, community participation or legal action.
10.3 Voluntary Participation & Accountability: All activities are voluntary. The Client may opt out of any portion but must communicate respectfully and understands they are not entitled to refunds or guaranteed results. They also agree to respect the collective experience and avoid disruptions.
10.4 Acknowledgment of Cultural Appropriation Risk: The Client understands that sharing indigenous teachings, songs, and medicines without consent can lead to cultural appropriation and entitlement and agree to do so with care, respecting wisdom keepers and their commerce. The Client acknowledges Ascension Arts is an integration-based company and is not rooted in a single tradition and reflects the Practitioner’s personal experience and intellectual property. The Client also acknowledges that their financial contribution to Ascension Arts supports the Practitioner’s commerce with indigenous teachers, ensuring reciprocity and preservation of these traditions. The Client agrees to seek written guidance from the Practitioner if unsure how to share about their experience.
10.6 Non-Compete & Non-Solicitation: The Client agrees that all teachings and materials from Ascension Arts are for personal use only and may not be used to offer competing services, retreats, or programs to Ascension Arts clients and members without written permission or an affiliate agreement. The Client also agrees not to solicit or recruit members, staff, or affiliates for personal or business gain during the program and for one year after participation. Any breach may result in termination of membership and legal action to protect Ascension Arts’ mission and wisdom keepers.
11. Agreement Duration and Enforceability
This Agreement is effective as of the date of registration and will remain in effect until the completion of the event and any agreed-upon aftercare sessions.
To the extent that any portion, clause or aspect of this agreement is found to be invalid, void or unenforceable, all other portions, clauses or aspects of this agreement shall remain in full force and effect.
We reserve the right to update, modify, or replace any part of these Terms in our sole discretion by posting updates and/or changes to this Site.
